Agreement
By using the site, creating a Portal account, downloading a free product or completing a purchase, you agree to these terms and the policies linked from this page. If you do not agree, do not use the relevant service.
Digital product license
A purchase grants the buyer a personal, non-exclusive and non-transferable license to use the included presets, samples, wavetables, granular sources, software and documentation in their own music, sound design, performances and commercial productions. You may release and monetize original work created with the products.
You may not resell, share, upload, sublicense, redistribute or republish the original files, isolated sounds, presets, wavetables, installers, license keys or substantially unmodified derivatives as a competing library, pack, software product or downloadable resource.
Plugins, activation and updates
Plugin products can require a Fractal Sounds Portal account, a license key, compatible hardware or software, and internet access for initial delivery or activation. A license belongs to the purchaser and must not be shared. Updates may fix defects, improve compatibility or change system requirements. Major new versions may be offered separately when clearly identified before purchase.
Compatibility
Product pages identify the supported formats, operating systems, hosts, synthesizers or required third-party software known at publication. You are responsible for confirming compatibility before purchase. Third-party products are controlled by their respective publishers and can change independently of Fractal Sounds.
Prices, taxes and payment
Checkout displays the price, currency, discount and applicable taxes before payment. Payments are processed by Stripe. A completed order is subject to successful payment authorization and fraud screening. Obvious pricing or catalog errors can be corrected, with a refund offered if an affected order cannot be fulfilled as advertised.
Delivery and Portal access
Digital products are delivered through the Fractal Sounds Portal or a secure link associated with the email used at checkout. Keep account credentials and license keys secure. Contact Fractal Sounds if a valid purchase does not appear, a download is incomplete or an activation fails.
Free downloads and communications
Free products remain subject to the same restrictions against redistribution and resale. Necessary delivery messages are separate from optional promotional email. Promotional messages require the consent applicable to the request and include an unsubscribe method.
Refunds
Refund eligibility and the request process are described in the Refund Policy. A full refund can revoke the corresponding download entitlement and product license. Partial refunds do not remove access unless a written resolution says otherwise.
Rent-to-own
Rent-to-own products follow the plan details shown before checkout. Access continues while the plan is in good standing and permanent ownership is granted after the required successful payments. Payments already made, pauses, resumptions, cancellations and Fractal Credits are governed by the specific plan terms displayed on the Rent-to-own page and at checkout.
Mentorships and creative services
Lessons, feedback, mixing, mastering and mentorship services involve creative judgment. Scope, deliverables, schedule and payment terms must be agreed for the specific service. Educational access is personal and private recordings or member material may not be redistributed.
Availability and responsibility
We work to keep purchases accessible and products functional, but uninterrupted availability cannot be guaranteed. To the extent permitted by applicable law, Fractal Sounds is not responsible for indirect losses, lost projects, lost profits or third-party software changes. Nothing in these terms removes rights that cannot legally be excluded.
Suspension and misuse
Access may be limited when there is credible evidence of fraud, unauthorized redistribution, abusive access or a material breach of these terms. Purchased access will not be removed arbitrarily. We will use proportionate measures and provide a contact path to resolve mistakes.
Applicable law and contact
These terms are governed by the laws applicable in Quebec and Canada, without limiting mandatory consumer protections that apply where you live. Questions can be sent through the Contact page or to francis@fractalsounds.ca.
